my wife has an H1B visa, it has already been extended and is valid until October 2021. Since November 2019 the PERM application for her EB3 greencard is running.
I have a H4-Visa, but I am currently still living in Germany. It is planned that I will enter the US before the I-140 petition is submitted. At the same time we want to apply for the H4-EAD petition for me.
My wife’s boss would like to save the fees for the I140 premium processing, but I have time concerns. We would probably get the I140 approved until October 2021, but not the I485. Could that be a problem or could we stay with an approved PERM/I140/H4EAD even if our visas expire in the meantime?
