Got H1B in Jun-2008,Didn't go 4 stamp.Can I apply now in Exempt Category?

Hi,

I got H1B approval in June/July-2008. I didn’t go for stamping. It might have expired in Sept-2011. And I never goto USA on any kind of Visa.

Now , I got to know that, with in 6 years of the approval, i can apply under exempt category.

In my case, Can I apply in exempt category in April-2014 ? (Or when can I Apply ?)

If yes, should I apply with the same employer or what ?

you can apply before 2014. any time with any employer
