Got 221g for criminal speeding ticket violation

Since you did not declare it on your DS160
What was your outcome of stamping,

  1. did your dropbox stamping got approved?
  2. Were you called for an interview?

I got two traffic infractions tickets… one for speeding and one for unsafe lane changing related to a minor accident . Both tickets were infractions tickets and not criminal. I paid the fine for both of them(less than $300) and cases are dismissed. I am filling the DS-160, do I need to mention these in the Security question, where they ask have you ever been arrested or convicted?? One of the ticket is appearing on my driving record as ā€˜convicted’ because I pleaded guilty and paid the fines. please help.

Yes you must disclose traffic violations in the DS-160, otherwise you will get a 221g which may delay the visa processing. I also recommend attaching all the court documents for both tickets with the dropbox documents if you qualify for dropbox, or carry them at your interview.

Can you elaborate on that also would it be possible for you to put up the whole story?

I have speeding tickets and both of them have been paid in court. I downloaded the Texas Public Safety records and found no convictions on my name. I did not disclose them in the DS-160 as I wasn’t arrested. Now I have my interview in three weeks time.

Would that be an issue?

Hello @nani_kumar. I did not see this message. Not sure if its late. I went stamping for two consecutive years for old petition and new petition. My ticket was mentioned as criminal and i got convicted for it so i had to disclose it in DS160. If its not criminal, you dont have to disclose. Check with your immigration attorney, they should be able to guide you.

@Karthikeyan_Velayuth If a criminal speeding ticket (Arizona) was dismissed by taking defensive driving class and more than a decade old do we need to declare in ds 160?

@tester_tester I dont think you need to declare in DS160 if it is dismissed. Mine was not dismissed, i got convicted so i had to disclose it in DS160.

Sorry for the late reply. My situation was unique. I received a speeding ticket in October for which I pleaded no contest and was given a deferred sentence for 6 months. I was supposed to not get any moving violations in the state of Texas. If I get any, I was supposed to appear in court in May.
And then one week before my end date in April, I received a speeding citation. I know my fate sucks but it was an emergency. I reached out to an attorney from Off the Record and he scheduled the court date for May first week.

But I had my trip to India for April along with my h1b stamping. I went to India, got my h1b stamped, and returned without any issues. The officers were very friendly and were helping out elders who came for their B1/B2 stamping. I would say there is no need to panic unless you have a DUI in which case you might be scrutinized more for extra proofs/docs.

Last update regarding my speeding tickets: Got my second ticket dismissed by the lawyer and the first ticket was also dismissed by the clerk when I went to the court to discuss it. I’m not sure why.

I didn’t update them in my DS160 as they weren’t on my record and also because I didn’t receive a conviction.
To answer your question about civil or criminal, all speeding tickets fall under the category of criminal in the state of Texas.

I am in similar situation as you. Got a speeding ticket in Texas (no DUI or damages), plead ā€˜no contest’, completed the defensive driving course, and have got the ticket dismissed.

Did you carry your dismissal / disposition letter to the interview / dropbox? Was the letter provided to you by your lawyer OR court?

I pulled type 3A records from DPS website and there are no records / citations (i.e. the report is clean). Can I use that as evidence of dismissal?

As of now, I have not disclosed it in my DS-160 but given mixed views, not sure if I should? Curious if there are any guidelines to filling that section of DS-160.

Hi @Karthikeyan_Velayuth, I’m in same situation. I was convicted for reckless driving in 2023, disclosed in ds160. My Dropbox was refused, requesting for in person interview with 221g to provide documents related to speeding citation. Today i attended the interview with citation, court disposition and fine payment receipt documents and explained this was a speeding citation, no dui or arrest involved. I still got another 221g asking to submit police report, I’m not sure for a speeding reckless citation there will be a police report created. Can you tell me what all documents did you carry during your interview?
