Former h1b employer indicted

A friend of mine just found out that his former employer was indicted for visa fraud. He got his first ( cap) visa through this employer in 2015.

He left the employer in 2016 and has been working at a fortune 50 company. He has had 2 approved petitions and has travelled out of the country many times.
His original application does not have a fraudulent MSA or anything like that. He has all his paystubs. But unfortunately he did pay a visa fee.

So far nothing is revoked. But does USCIS go 4 years back in cases like these? Should he be worried of an upcoming NOIR?

Well, it all depends on the indictment and involvement of the employee as well, knowingly. Check H1B Indictment Employees . It is very hard to give a generic answer, they may go back, hard to say…Please check with an attorney.

Thanks yea most of these reports are about current employees. Since he left 4 years ago I’m hoping it’s all good.

You can ask your current immigration attorney, just to be sure, if you are are worried.

Can you elaborate what kind of visa fraud it was? Are you aware of what your former employer was doing? If you can prove to USCIS that you are also a victim, I guess you are fine.

Fake MSAs. His application did not have one though.
