Can a new employer file for my new H1B and get an approval within US while my old H1 to H4 COS is pending. I understand that usually the change of status to H4 takes anywhere from 3-6 months. If during that period, I get a new job offer , can I get a new H1B filed through an employer and withdraw my H4 cos application?
These are different process tracks. Your H1B process will not be affected by your H1 to H4 change of status request. You can withdraw change of status request once the H1B approval comes through. If status to H4 occurs before H1B approval comes through, then simply request to change back status. This is done almost every day by USCIS.
