I received a Request for Evidence form USCIS saying that I need to maintain my Student (F1) status while my I-539 is pending. I applied change of status from F1 to H4 in a timely manner. But Covid-19 hit and my application was delaying longer. Now, my F1 visa was already terminated (that’s the fact), but I am still in the US due to Covid-19. Can I appeal to USCIS saying that I apply change of status from F1 to H4 on time but due to Covid that my F1 was terminated before my I-539 is being processed?
Here is my time line:
April 3rd, 2020 - applied I-539 from F1 to H4
September 29th, 2020 - F1 terminated
October 28th, 2020 - Biometric taken
February 11th, 2021 - Request for Evidence
