F1 to h4 ead when spouse's h1b is in transfer

I on H1B with i140 approved. I want to change my employer and since premium processing is not available, I will have to go with regular processing.

My wife is on F1 OPT and this is her last year on OPT and her company is applying for her H1B. If it does not come in the lottery, we would want to go for H4 EAD. Can she apply for F1 to H4EAD change when my H1B transfer is in progress?

Now H1B Premium processing open, you can try that option.

Yes, she could apply for Change of Status using the receipt, if her I-94 is valid and not expired. But, better suggestion is to upgrade your H1B to premium and get the approval as it is open now…it will be more helpful for H4 COS later on…Double check with your attorney to be safe.
