I am sure this question is too early to ask.But hoping your answer might help us have the right decision taken.
I am working for Company A on H1 B & I-140 approved with them.
If I move to company B by transfering my H1B I heard that my priority date would not change but the whole process has to be repeated. That means I need to get my I-140 approved again.
In this scenario, If my spouce who is on H1B now, moves to H4 after I move to H1B with company B - would she / he be eligible for H4 EAD (if the proposed rule becomes a law) before the I-140 is approved for the second time ?
