Eligible for Cap-exempt or need to apply fresh H1B

I had stamped my H1B visa and it was valid from 2013 to 2017, but never got chance to US.

In between i left employer and they revoked my visa in 2015.

Now i joined same employer in Jan- 2019,
My question are :-

  1. Do i need to apply for fresh H1B application for 2022 years and it will Cap-exempt?
  2. Do i need to use expire visa to extension purpose?

Could any one please help me.

Did you join on H1B and currently working in the US?

Not on H1B , I joined same employer in India only. Never got chance for US.
