Eligibility for Cap Exempt H1B

Hi,

My H1B was stamped in Oct. 2006 and it expired on 30 Sep. 2009.

I worked on H1B in US from Jan 2007 to June 2008. I returned to India and visa was not extended.

Am I eligible for cap-exempt H1B petition?

There’s a confusion around 6 years clause.

Is it valid for 6 years from the date of approval or the date of expiry?

Please guide.
