Duration before switching Employer on Fresh H1B

Hi,

If I get a fresh H1B approved for employer A, how long do you think I need to work for employer A, before switching to employer B. Considering I’m on L1B and in USA already for employer C.

There is no minimum time you need to spend w/ A. You can switch to B anytime as long as you are maintaining legal status.

  1. If H-1 gets approved prior to Oct 1 w/ COS, then B can file for cap-exempt petition for you before Oct and you can start working for B from Oct 1.

  2. If you start working for A from Oct 1, and B files for transfer before 3 pay periods, then you need to submit payslips for all those pay periods.

  3. If you start working for A from Oct 1, and B files for transfer after 3 pay periods, then you need to submit payslips for most recent 3 pay periods.
