Doubt regarding premium processing

Hi,

I am currently in US on H4 visa. My employer has applied for H1B on April 1st 2014.

If the petition is approved by USCIS, then I am eligible to start working from October 1st 2014.

In this context, I have the following doubts.

  1. Is there any use of premium processing in my case? I dont have any previous H1B experience.

  2. Is COS from H4 to H1 a separate process compared to my petition approval?

  3. Since my I-94 is valid till 31st Dec 2014, I think I can start working from Oct 1st 2014 without any stamping in between. Is my understanding correct?

Please clarify.

  1. PP doesn’t expedite your start date, but does tell you about the result earlier than other petitions.

  2. Your employer could have applied COS along w/ the original petition. If not, they will have to apply for it separately.

  3. Yes, provided your COS gets approved.
