Does my Spouse on H4 Visa need a new Stamp after H1B Transfer? with existing VISA stamping expired and have new I-797A

Hi Everyone,

My H-1B VISA stamping has expired on 26th July 2022 from Employer A and I have new I-797A from Employer B (but stamping is not done)

With this my Spouse on H4 Visa need a new Stamp after H1B Transfer?

Any guidance would be greatly appreciated!

Note: During H-1B transfer spouse was in India!

Thank you,
V

Your spouse can travel to the US as far as the H4 visa is valid on the day of entry in the US. No need for stamping just because you changed the employer.

Thank you, Kalpesh.

Her previous VISA had expired, in this case she has to get new VISA stamped?

For new H4 VISA stamping dose she need primary H-1B applicant stamped VISA copy or I-797A approved copy is good enough?

Yes, if she is outside of the US. If she is present in the US, you will need to apply for H4 extension of status, no need for visa unless she is traveling outside the US and wants to come back.

I-797 along with other H4 documents.
