Do we need to provide last year's H1B denial case no in the new petition

Hi ,

My wife’s H1B denied last year and we are planning to apply this year again with the different employer

i)Do we need to provide last year’s H1B denial case no in the new petition ?

ii)If so what will be the impact for new petition ?

Last year case was denied due to job not qualified as specilaity occupation

  2. It is ok for the previous petition to be denied. It doesn’t impact your new processing as long as the reasons were not related to your wife. As it was related to the offered position, it doesn’t impact the new processing. If you want, you can let the new employer know about the reason.
