Hi All, I have a question related to H4 EAD:

My H-1B visa application was not picked in the lottery (this was my 3rd & final attempt). My husband’s I-140 is approved and his H-1B visa is eligible for extension on Sept 1st 2024. Can I apply for H4 EAD now and again with my husband’s H-1B extension(under premium processing) if first H4 EAD has no update from USCIS by the time.

You dont need to apply twice. If its pending even after the H1B and H4 extension approval, you can submit the copy of I-797 approval notice for both H1B and H4 to the service center processing your EAD application.
