Changing employer while H1b extension is under REF with current employer

I have approved 1-140 since 2014. My H1b extension got RFE now with existing extension copy going to expire in July 31st…
In this situation,
1)Is it possible to switch the employer for H1b transfer/extension under premium process without resigning previous employer until extension from new employer get approved. …
2)Is it possible to do same thing after my current extension copy expires (July 31st)?
3)what to do if previous employer RFE cleared & also new employer H1b transfer/extension successful.
4)what to do if previous employer RFE denied but new employer H1b transfer/extension successful.

  1. Yes, you can.
  2. If you apply for any new employer after I-94 expiry, then you may fall into bridge situation where you need the pending petition to be approved.
  3. it is your choice, whom to work with.
  4. If you do anything before I-94 switch you have choice to choose employer…
    All of these are really tricky situations and I suggest you discuss with your attorney and make informed decisions…
