I have two willing employer(A and B) to file for my H1B. I am currently working with Employer A and have offer from Employer B, but havent joined B.
Say My h1b is picked from B, do I get automatic cap gap for my OPT authorization?(my OPT expires in Mid May) or Cap Gap applies only for the Employer A(my current employer)
Well, if you have two employers, it is slightly tricky…As long as one of them has H1B pending or approved, it should apply automatically…You need to check with your DSO as well on this, how it will play out…Talk to them and do update here for community benefit.
Confirmed with DSO. Cap gap is independent of Employer. If lottery is picked, I will get cap gap.
