Currently on STEM OPT with an E-verified employer, got a job in new company which isnt e-verified, can they still file for H1B with start date October 1st? Can I do sub contracting with current employer with the new company till H1 gets approved? Will I be eligible to get Cap gap extension?Please help its very urgent.
Yes, they can file. You should not have any problem and you will be eligible for cap-gap extension. Talk to your company they will put you into their known contracting company who is e-verified.
