I had an approved h1b in 2018 which I didn’t use to travel and it got expired in 2019 ,however I got the stamping done.After my discussion with multiple attorneys I got to know that I might be coming under cap-subject petition because I was never on H1b status.For this I have got one employer who’s willing to file a cap sub petition this year and they have already registered me for the lottery.
While this all was going,I have got another employer who told me that they can file a cap-exempt premium processing petition for me.Hearing this I was happy to proceed and they also filed my cap exempt process on march 1st ,2021.
I am not sure if my new h1b registration might impact the outcome of cap exempt h1b?Any thoughts…?
