I initially went to US on an L1 visa. Over a long period, I did an MS in US by doing change of status to F1, worked in OPT and finally did by H1B from my employer in Nov 2011. Then did an H1B extension in 2014. However, since I had a prior L1, my maximum period of stay of six years expired before my H1 reached six years. Now I am back in India since March 2016, and after one year cooling period, my employer has applied and got a cap exempt H1B for the reminder of the 1.5 years in my H1B. My question is, if I now travel and start working in US, and in 2019 when my petition expires, would I be eligible for a cap exempt extension or should I go through 2019 cap?
