I had a H1 visa valid from Oct 2009 to April 2012. I worked for 2.5 months from Nov 2009 to Jan 2010. What is cap exempt H1 and am I eligible to apply. If yes what is the procedure.
Cap-exempt H-1 is when you have a previously approved H-1 petition. Recently, experiences have been shared where people have received this even when it is filed after 6 years of old approval. So yes, go for it.
Find an employer willing to hire you in US. Tell them that you are eligible for cap-exempt and let their attorney handle the process. You would need previous approval notice and payslips for the period you were inside US.
