Can we use approved & expired H1B petition now under cap exempt?

Hi Friends,

I have approved H1B petition(I129) and it's validation is 06/28/2004 to 11/06/2006.
I have never used this petition to get visa stamped and not traveled to USA.

Petitioner who had filed this petition is no more in the business now.

It would be great help if any one of you answers my below questions.
1. Is this expired petition can be renewed now in 2014?
2. Can I now use this petition under cap exemption to get H1B? If yes then please tell me how.

    -No , as approved date was 06/28/2004 , You could have been cap exempt till 06/27/2010.
