can we go for H4 visa stamping who has already H1B with RFE status

Hello ,

This is Nagesh, Please guide me how to proceed for my current situation.

My company is processed H1B for the fiscal year 2016 and its approved status.

And i am processing H1B for my wife’s and its in RFE status now.

could you please suggest us ,How should we proceed in this current situation.

  1. Attending H1B visa interview along with my wife as dependent H4 Visa ?if so is it any impact on her H1B Visa?

  2. Attending H1B visa interview without adding my wife as dependent , and will apply later as H4 for my wife in case H1B visa rejected?

Don’t be panic. I would suggest first take her along with you as a dependent and get H4 stamped even though her H1B is in process. Before her travel to US, if her petition is approved, then ask her to attend interview and travel with H1B instead of H4. If not, ask her to travel on H4 and in future if its approved, then she has to go out of country or file change of status to use her approved H1B. Let me know if you have any further queries.

Could you please respond to below things while attending H4 visa stamping.

There are chances to ask this below Q’s while facing H4 visa interview
and also heard that in some cases H1B application got cancelled with below q’s

  1. As you have applied H4 and you have already H1B visa (in process / Approved), which one do you want to continue now H4 or H1?

How to answer for the above q’s? and how to avoid cancelling the H1B application?

  1. is there any chances to H4 rejections if we say, we would like to go as H1B?
