Can someone leaves the organization after I140 is received?


Is this possible to extend the stay in USA after the I140 is approved and if someone leaves the organization ?

If the company withdraws the I140, can the Priority year/month in EB2 is still valid if the new company again files GC process?

What is the minimum period one has to stay in the present organization after the I140 is received so that by process of USCIS/DOL, it will not be revoked before switching to another company?

Please suggest with your valuable input.


There is presently no minimum stay after I-140 approval. You have to make sure your relationship with company A is not too negative, because they do have the right to request revocation if they feel like doing it. Some do, many don’t.
