Can I travel to India Before H1B approval currently holding L2 Visa?

I am on L2 Visa and file H1B this year.after applying H1B I want to go to India and come back in 3 weeks. Is there any problem with my H1B Visa processing if I leave this country before H1B visa approval?

It depends if your visa is being filed as change of status or counsular processing.

  1. If it is in COS then you should not travel prior to getting a decision on your H1

  2. If it is CP then you can travel but you will again need to get it stamped before moving to H1
