Can I travel on H1B with I-797 softcopy

Hi Saurabh,

I had applied for an H1B new visa in 2011 and it got approved for one year from June, 2012 to 2013 and the visa stamping was done for the same. But, I could not travel to US as there was no requirement in our project.

Now I have moved to a different project and they have filed for an H1B Amendment and the same is approved by USCIS, but I have not received I-129 hard copies yet, can you please let me know if I can travell to US with I-129 softcopy which was email to me?

You will need amended 797. I-129 is a form your employer files w/ USCIS and once approved, they issue the 797. So wait until you get physical copy of 797, and then travel to US.

You can ask your attorney, if it is ok to travel w/ print-out of a scanned copy of 797 (USCIS will send original 797 to your employer office in US and they can scan it and email it to you. So you don’t need to wait for them to courier the physical copy to you in India).

Thanks Saurabh, you are correct its I-797, I wrote it as I-129 by mistake.
