Can I transfer a new H1B to another company ?

Hi,

I have an approved H1B petitiion. Its a h4-h1 conversion through a consultancy. Can i transfer my H1b to a full time employer right away ? Or do i have to work on this h1 for a while and then only transfer it?

You can do it right away. If you stay for current employer for more than 1-2 weeks, then you will need payslips from the employer to show that you have been maintaining legal status. The answer assumes your H-1 was approved w/ COS.

Thank your for your reply. The h1 is approved with COS. My H1 got approved on Oct 12th. I still have not got my approval papers. So, if I transfer my H1 before I get SSN can it be done with out any pay slips ? Or is the 1-2 weeks calculated from the day H1 was approved ?

1-2 weeks is from H-1 approval date. You are considered on H-1 status from Oct 12th. So you should apply for transfer ASAP or else have 2-3 payslips before applying for transfer.

I am in the same situation. my H1b got approved on 25thOct.
how can one apply for transfer without getting the papers? is the receipt # is enough for the trasnfer?
