Can I still apply for a Green Card once H-1B expires/ rejected

Hi all,

I’m currently in the process of extending my H-1B, haven’t heard anything back from USCIS. My current H-1B will expire on August this year.

I’m just preparing for the worst case scenario here. Can my company still apply for a green card if my H-1B extension gets rejected? (We haven’t started the green card process yet, still need to go thru labor cert first)

Would this go under consular processing application?
I’m still not clear about the consular processing, does it mean that one can apply for a green card without obtaining H-1B first?

you must be thinking too much around this. Simple fact is : Your GC petition has NOTHING to DO with Current or any other H1s.
In fact, you never need to enter into US for a company to file your GC.
