can i attend H4 interview if i have valid stamped h1B?

My spouse going to attend H1B interview and along with him i’m going for H4. But i have a valid H1B stamped visa valid until Dec 16. But i have no plans in travelling in H1B. Is there any possibility, this case will affect my spouse H1B getting approved?

Can i attend the interview along with him? will there be any complications? Please guide me

You can appear for stamping along w/ H-1 holder. Couple of things may happen:

  1. Your H-4 would be stamped with no impact on your H-1 visa

  2. Your H-4 would be stamped and your H-1 visa would be canceled w/o prejudice. However, you are still eligible for cap-exempt petition in future.
