Can I apply for H4 while my H1 Stamping is stuck at 221g from 9th May ?

Hello Sir,

I appeared for H1B Visa stamping on 9th May,2017 at US Consulate Mumbai, India. I was give 221g with “Additional Administration processing required” check box. My Case was earlier went into RFE and my employer has provided good number of documents that time.

  1. As my case was already scrutinize by USCIS, is that a possibility 221g process get resolve within 1 months time?

  2. As we are uncertain on the time frame, meanwhile can I apply for H4 to visit my spouse in USA? Will there be a issue on H1B 221g process?

You certainly can, if you have the passport with you. I would say that you wait on the result of your admin processing.

Admin Processing generally takes 30-40 Days. I will Suggest wait for 40 Days & then decide.

BTW, If your Case is under Admin Processing, i hope your passports must be with Embessey. In that case anyway you cant go for H4.

No, they game me back the passport. I have it. I will wait for 30 to 40 days - that I can do. But I think it will take more than 60 days. I am worried.

Few post I read mentions - if you are not asked to submit any documents then you case may be forwarded to fraud detection team and in that case it can take 3 to 6 months.

If they have given your passport back without stamping, then yes, it may take time.

Could you please let me know as to what did you do? I am in the same situation and it will help me take a decision.

Did you apply for H4 and was that proecss smooth?

My h1b in 221g pending but i have approved h4 so want to travel to US on H4.Should i withdraw h1b application by email or in person when i go for h4 interview ? or i can just get h4 and h1 remains processing ?
