Can dependents use existing H4 visa to travel for first time after employer change with receipt notice

Hi,

I joined a new employer last week with the receipt notice of the H1B transfer petition that my new employer had filed.

My petition status is still in Initial Pending state. The petition was filed in regular mode.

My dependents have their H4 visa stamped when i was working for my previous employer. They have not travelled to US so far. They will be travelling only this month for the first time.

I have a few queries.

1. Do they need to go for stamping again as my employer has changed?

2. Will there be a problem at POE as i only have the receipt notice for my new employer's petition, and my previous employer petition would have been revoked?

Please clarify.

Thanks,

Bhaskar

There will be no problem. H-4 is a status visa, it is not linked to any employer directly but is connected to you. Even in your change of employers, the H-1B status never changed and therefore the H-4 continues to be a sustainable travel document for the family. There is no need for stamping and there will be no problems at POE.

Best wishes
