can anyone file GC under EB1 when met eligibility?

Hi Saurabh,

My husband has masters degree from India and more than 10 years of experience in IT and he worked with a company ABC as project Manager cum Solution Architect in India and came to USA through H1B through them and moved to XYZ an year ago. My husband says he is eligibile for GC under EB1 through ABC company, but its financial status from past one year is very poor. Can XYZ file GC under EB1 to my husband or  onlyABC can file? Can you please suggest?

Any company that has an opening that matches his requirements can file GC for him. If that job qualifies for EB-1, then it can be through ABC or XYZ, doesn’t matter.
