Approved H1 but Can I enter on L1

I am Currently working for employer A on L1 visa which has a validity till 2014 end.

I have an approved H1b - COS is 1 oct.

I have to travel to India and cannot skip that in september. If I enter US on 28 sept on L1 can that be a problem. I am avoiding stamping at this time.

Or SInce My wife has H1 can I resign before leaving US and enter on H4 on 28 sept and automatically my status will change to h1 starting 1 oct — do you foresee any problem in this ?? Please suggest

You can return on L-1 on Sep 28 and still be on H-1 from Oct 1. This is assuming your L-1 employer is willing to call you back to US on L-1. If not, then return on stamped H-4 visa and be on H-1 from Oct 1.

Talk to your H-1 attorney as well.
