My H1B petition expired on Sep 30 and before the petition expired my employer filed for amendment which is still in progress, now my employer wants the petition to be renewed. Do we need to withdraw amendment to file for petition renewal? Can someone provide the timeline it takes for amendment withdrawl and file renewal in premium
You cannot ammend an expired petition
You need to apply for H1 extension before the expiry of previous H1B to remain in status. Your corporate immigration lawyer should know this. If you have not yet applied for extension, and your previous petition expired on Sep 30, you should not be working at all and may be out of status currently.
