About My H1 B Old Stamped petition

Hi,

I have H1-B visa stamped in dec-2007, and i went to US in Apr-2008 stayed there for 4.5 months, and no payslips ran on my name , i came back after 4.5 months ,

Now can i reopen that old visa under cap_exampt. If yes let me know required documents.

Can i ask my present employer to reopen this visa , Is it possible.

I assume your original petition was filed by a different employer and now you are working with a different one.

Whatever be the case, I believe you have expired 6 year period from Dec-2007.

You will need new H1 under CAP.

I saw some H1’s , reopend after 6 years also in my current company, is it possible with same employer?

I believe there cannot be a case like that beyond 6 years and if you have already used partial.
