Last year my H1B petition was approved from Indian employer but it was never stamped & I don’t have any details (receipt no,EAC no,approved copy) due to compnay policy .So new employer have applied for new H1 this year so would that be part of lottery or it would be cap exempted ???
Most likely your new employer didn’t include the old petition details in the filing. In that case, it is subject to the cap.
If you can get at least the old receipt number, then an employer can file a cap-exempt petition (aka H-1 transfer) for you.
