When Do I Use the Premium Processing Service

Dear all,

Here is my situation,

My H1B petition is getting expired on July 30 2013

HR has procured my LCA on Apr 18th,

My current project is ending on May 31 with the current client, after this I might not have a project.

I was thinking of premium process, but HR told me that should be before procuring the LCA, is that true?

Premium Processing applies to H1B petition and not LCA.

LCA certification by DOL is a requirement for H1B petition. LCA may take upto 7 business days to get certified. After that when you file H1B extn, you can do it in premium processing.

LCA is through Department of Labor, H1-B is through USCIS. You can file your H1-B petition with USCIS using regular processing, or premium processing (costs $1,225 more). If you file with regular you can even change your mind and upgrade to premium processing (by paying the extra $1,225 while it is pending), once you have a receipt number.

So it is probably not too late too use premium processing.

Thank you for your answer, I have another question, HR said my LCA was procured on Apr 18, and they said that my case will be removed from LCA notice board on Apr 29.

  1. and as you mentioned LCA takes 7 days to get certified, so this 7 day is starting from which day? Apr29? Apr18?
  2. After recieving LCA certificate what takes time for HR to file petition? can they file on the same day LCA certificated?
