what to do if we dont get paid from a consultancy

me and my spouse are planning to get a new h1b from a consultancy ( we are yet to finalise on the name of consultancy thru which we would be finalising).

  1. I read a lot of reviews about consultancy that some of them dont pay or some of them pay late.

In this case, can we transfer the h1b to some other employer or can we search for project ourselves and move to other company? If both of us dont get paid then it will be a big problem, also most of the consultancies do give us one year bond or we have to sign a contract with them for one year.

  1. How to confirm from the consultancy if they have filed h1 for us(as this year there is a lottery, a consultancy can easily cheat by telling that they have filed for us, but later come back saying we werent selected). What proof can we ask them for to know if they have filed for us?

  1. U can go for Transfer. There is no such bond in US, BONDS are illegal. U can also sue consultancy if not paid

  2. U can ask for I-129 filed for U and copies of docs submitted to USCIS
