What are the options after in-cap H1 denial?

Hi,

My wife’s in-cap h1 got denied for speciality occupation after an rfe. She never travelled to USA. What are the options to fight for the case and what kind of documentation would be good? Any information or leads towards this will be highly appreciated. It’s so painful to loose a petition after getting picked in the lottery.

Well, it is hard to say what would be required, without knowing the full reason for denial. Only your attorney can tell the reasons. If the job that they filed for does not fall under that, then it is an issue…
Discuss with your attorney and employer and then proceed.

Thank you for taking time to respond! Unfortunately, this is with an MNC. They’ll neither share the denial notice not she’ll have access to talk to the attorney.

Well, then you would not know…In general, H1B is an employer thing and they are not mandated to share you everything, either MNC or not an MNC…
