I have read some people have more than one application for H-1 from different employers and they got both applications selected also in the lottery. Then what does USCIS do for these kind of candidates? The quota will not be complete if there are duplicate filings. Will they select again from the unselected list of candidates?
As far as I know, if same Passport number is selected more than once in the lottery (provided its for different employers), USCIS will count it as one out of the quota. I think the remaining counts will be applied to next year’s quota.
Its Duplicate and Eliminated only if it is filed twice from same employer… other than that each application is considered as of now
All H1b applications for the same candidate will be processed (if selected in lottery) as long as they are filed by separate employers.
But the question was about the count against the quota. As far as the count for such applications against the quota is considered, I think one candidate is counted once, even thought he might have multiple applications.
NO I think, If two got selected… It means two are counted in quota…
‘x’ number of petitions from ‘x’ number of different employers…if all ‘y’ petitions are picked up in the lottery…
All those ‘y’ petitions are counted against quota.
Remember that quota is per position not per individual.
Same employer - multiple petitions - not good
Multiple employers - multiple petitions (one petition per employer per individual) - is valid
