Very urgent - H1B transfer question

Hi Saurabh,

I really need your help/suggestion for my case/scenario.

I work for indian MNC company A on H1B in west coast. I have location constraint, so was searching for options outside and have happened to talk to a consulting firm B. They have scheduled client interview, got selected and based on my discussion with them, have given 2 weeks notice to my current employer A. Now employer B tells me he is waiting for some document and has not yet filed my h1b transfer petition to USCIS. My last day with my current employer is 09/19th. Employer B tells me that he would file it tomorrow i.e. 09/18 and assures me that the day document gets submitted to USCIS, i can be on his payroll from 09/22. So my questions are:

(1) Can i be on his payroll from 09/22 on Fedex tracking number. Because, not sure if i would get the receipt number from USCIS by then

(2) Will i be out of status in this gap till i get the receipt number. Is it safe

(3) Do you suggest me to take back my resignation and be with employer A

Go with (3)take back my resignation and be with employer A Option.

Please avoid such employer lots of time they just don’t have enough credential and moreover you can always ask them to first get the H1B transfer done then notice your employer. This way you will always safe
