Hi - I had a question about H1 visa transfer. I have an approved I-140 petition and based on that an approved H1B extension till 2017 (for 3 years). But I left job and left US for a while and came back to India and plan to stay here for another 3 years. Hence I have never used that approved H1 petition which is due till 2017 a smentioned above.
Now my question is after 3 years lets say in 2017 if needed can I use the same petition and file an H1 transfer (cap exempt) with another company ? As that H1 petition was not used by me will USCIS grant a new petition based on that ?
