Urgent Help H1 Extension Denial

Hi

I am in a urgent situation where in I don’t know what to do . Any help or information would be appreciated.



 



Did not change the company, I am still with same company and here are my details.



 



H1 Stamped on Passport : 30th September 2015.



I797 Validity : 30th September 2015.



I94 : (7th March 2014 ).



 



Appiled H1 extension as my i94 was expiring. Company policy is to apply h1 extension even if the i94 is expiring.



So they applied h1 extension and got denial notice today(march 18th ), not sure what is the denial reason. It will take 10 days to know the reason.

Now can I go back to india and come back on same visa which I am having. is my visa still valid. I don’t have good relations with manager so if I go back to india he will never send me to india.



 



So I don’t want my manager to know about the denial and come back to USA as nothing happened. If they me to india, I would go after 10 days but I want to get a legal status by then as I have valid visa. Is my understanding correct.



 



What are the other options.

The H-1 extension was denied because it was filed too early before expiring. Yes, you can go to India and come back on same visa. Hopefully CBP will now give you an I-94 till Sep 2015 (not sure why they short-stamped it the first time, do you know the reason?). I am sure others here will agree with my reasoning unless I am missing something here.

Thank you very much for the response and time. the reason for the early i94 is because of the passport expiry. i got the new passport now if i go to india and come back it should be fine as i have fresh passport.

my only concern was that will old visa and i797 will get expired/cancelled as the new was denied.

Nothing to be concerned then. The denial of extension is on a USCIS computer, the point of entry is on a CBP computer and moreover your visa is anyway valid till 2015 (it is a 100% legal entry), it is only the extension beyond Sep 2015 that hit a snag.
