Unused H1B Transfer

Hi,

My wife’s H1B was issued in 2019 and was never activated. She is currently working with her EAD. Now that EAD renewals are going slow, can she transfer/activate her H1B with a new employer?

This is possible however approval will depend on the adjudicating officer as she never worked for the sponsoring employer. No harm in finding H1B employer and having them apply cap-exempt H1B petition.

Assuming her H1B already expired, it is the same process for her sponsoring employer.

Yes, it expired unused. Any prior experience on chances of getting it activated?
