Travel to India after H1b transfer approved with New Employer

Hi,

I am waiting to get my H1b transfer petition approved with my new employer. My visa is stamped with my old employer (I am yet to resign my job with old employer). I want to know if I can travel to India and return with my existing visa stamp & new approved petition or should I get my visa stamped for the new employer and enter US?

I want to make sure that I will be allowed at the POE with my old employer visa stamp and new employer I-797 approved petition

Thanks in advance

Aravind

You can enter USA with old visa stamp and new petition. But pros and cons of getting fresh visa stamped in India are as follows:

Getting fresh visa stamped in India will permit you to visit India any time later during visa validity.

But you also have a small risk of of getting 221 G and having yr application on hold

Decision is yours

Thanks for the response.

I still did not understand clearly. I am not going for stamping. I am trying to find if I can re-enter USA with my old visa stamp which is valid until May 2017 and new petition. If I got to India, should I get my visa stamped with new employer? Is it a must?

You can reenter USA with old visa stamp and new petition
You can also apply for fresh visa stamping in India, if you want.
Advantage of fresh stamping would be that it would have longer visa validity . If you are required to visit India after May 2017 ,before expiry of new petition , you will not need stamping
