Travel constraints in L1B to H1B.

Hi,

I am currently on L1B visa from an Indian IT Firm, valid till end of next year. My company initiated H1B for me in this april slot and it is considered as L to H conversion. Due to my personal need, i have to go back to India in May and return back to US by Jun. I heard that returning to US with current L1B VISA is not possible because of LtoH conversion is filed. If i go to india, whether i should return to US only if get H1B stamping. Please clarify....

If you leave US while H-1 is under process, then your COS will be abandoned. You can still return on stamped L-1 visa, or on H-1 visa (but on this you can only return after Sep 20th and H-1 petition should be approved for this). Once in US on L-1, you can file for a separate COS from L-1 to H-1.

If you leave US after H-1 has been approved w/ COS, then you can still return on L-1 and be on H-1 from Oct 1 based on earlier approved COS.
