Should I go for MTR If I have only SOW?

Hi,

I have received RFE under H1-B. So I submitted MSA, SOW and Supporting documents instead of client letter on 10-Oct-14. Because it was too late so I applied for Premium Processing and with in 2 days I got denial notice on 4-Dec-14, reason was “USCIS specifically noted the termination date of both the MSA (August 31, 2014) and the SOW (June 30, 2014).”

So now I have only SOW from 1st-Jan-15 to 30-Jun-15. Should I go for MTR? How long they will take because it is already under Premium Processing?

I would not recommend you to go for MTR. There is only 5 % chance of success. And even that in situations where you have all the proper evidence available. They hardly go against their decision. But since this is a due process so you can always take this approach.The best option is to apply for the MTR and parallel to that file a new H1B with all the proper documentation. There is a good possibility that you will get the new petition approved.

Please suggest how long it will take to approve my petition?

If:

  1. On 18-Jul-14 Received RFE
  2. On 10-Oct-14 RFE Responded & Received
  3. On 2-Dec-14 Premium Processing
  4. On 4-Dec-14 Denial notice due to expired MSA and SOW
  5. On 30-Dec-14 Filed MTR with valid MSA(Valid till 31-Dec-15) and SOW(valid till 30-June-15)
  6. On 04-Mar-15 received status “Case Was Reopened For Reconsideration”.

Please suggest how long they will take?

It takes roughly about 10 to 15 business days…

10 to 15 days for decision? or to receive notice for further formalities?

Either one. You will most probably get a decision now. Otherwise this loop of rfe’s continues…

What are the chances? If I am working in India’s top 10 IT Software Company MNC.

There is always some hope. Even 5 % chance is enough to get a favorable decision. Now its all about your luck. They can overturn the denial decision if they want to…

From where I can check it is approved or denied? The notice they will send or online only?

Get enrolled in their online system. You get any update over uour cell phone and through email also…
