Should I be worried that I got a 221(g) even tho no docs were requested and they kept my passport?

My H1B petition was approved but an administrative error resulted in late filing and an accidental overstay of a few days. As a result, my extension of stay request was denied and I had to immediately go back to my country for stamping. The interview was nerve wracking and they asked a lot of questions about the overstay even though I showed the nunc pro tunc letter and the response from USCIS. In the end, the officer give me a 221(g) white slip but no documents were requested and he kept my passport. He said he just had to do some administrative processing that should take a week or so and that I should wait for them to contact me.

Given that overstays are taken extremely seriously, should I be very worried? I wasn’t denied outright so that’s a positive outcome. I’m just worried about to expect. He did keep my passport.

221(g) is a very tricky thing and the outcome is mixed. You can look at our 221g tracker stats , you did what you can and handled it well. It is very hard to tell…they may leave it as a genuine mistake and let it go without any issues. You did what you can, it is beyond your control now. Hopefully, all positive will come. Good Luck !

Thanks for the good wishes. I just wish I knew what to expect. When the officer spoke it seemed like just a minor thing he had to take care of, but now I’m researching what administrative processing is, it definitely might be more serious than I thought. This is a community where we all can relate to the stress of this, especially those of us who have already been working and living in the US for quite a while.

hey H1bRenewalguy, what happened with your case? did you get the passport in a week?

It was approved in 10 days.
