I am having H1b visa valid till Aug-2015.I have returned from US after my first assignment a month back .Is it possible to travel on the same visa again to US from a different company from my home country as there are no opportunities in the current company to travel.
The new employer needs to file a cap-exempt petition for you. Once approved, you can travel to work for new employer using the new approved petition and old visa stamp (provided it has not expired).
Thanks Saurabh. Is there any time limit when the petition needs to be filed?. Also how much time it might take for this new petition to get approved?.
It needs to be filed within 6 years of original approval. Processing time is 2-4 months under regular processing.
