Second masters- No OPT-When can I start working if H1B filed

Hello,

I am pursuing my second Masters and am graduating on May 2014.



Since I will not get another OPT, I want to know if I can start working from April 2014 if my H1B is filed that year?



or do I have to wait till October? Does Premium processing make me eligible to start working sooner than October?

You will have to wait till October 1 or later if you never had a H1. Premium processing would only help in getting the decision fast it won’t make you eligible to start working prior to October, you will still need to wait till October 1 to start working.

To add, you can continue to stay in US based on cap-gap but cannot work (until Oct 1 or H-1 denial date, whichever is earlier). This assumes your H-1 is filed w/ start date of Oct 1 along w/ COS from F-1 to H-1.
